Zoning By-law Amendment ZBA-36/21 (By-law 2021-116) has been initiated by the Township to amend Comprehensive Zoning By-law 2014-14. More specifically, to amend existing provisions pertaining to legal non-complying lots, buildings and structures, and to amend and add provisions to assist in regulating the use of accessory buildings in the Waterfront Designation.

In summary, the effect of the proposed amendment will be to:

  • prohibit enlargements to dwellings and sleeping cabins on undersized lots;
  • add clarifying language regarding exterior extension of buildings and structures within required yard setbacks;
  • prohibit second storey additions where lot coverage is exceeded on undersized lots;
  • prohibit shoreline

Zoning By-law Amendment ZBA-36/21 (By-law 2021-116) has been initiated by the Township to amend Comprehensive Zoning By-law 2014-14. More specifically, to amend existing provisions pertaining to legal non-complying lots, buildings and structures, and to amend and add provisions to assist in regulating the use of accessory buildings in the Waterfront Designation.

In summary, the effect of the proposed amendment will be to:

  • prohibit enlargements to dwellings and sleeping cabins on undersized lots;
  • add clarifying language regarding exterior extension of buildings and structures within required yard setbacks;
  • prohibit second storey additions where lot coverage is exceeded on undersized lots;
  • prohibit shoreline structure additions where width requirements are exceeded; and,
  • improve the overall clarity of Section 3.2 of Zoning By-law 2014-14.

The effect of the proposed amendment will also be to limit in Waterfront Residential zones:

  • the number of certain accessory buildings to two (2);
  • the cumulative size of certain accessory buildings to 1000 sq. ft.;
  • the height of certain accessory buildings to a single storey with exceptions; and,
  • add certain related technical revisions.

    EXPLANATION OF THE PURPOSE AND EFFECT OF

    THE PROPOSED ZONING BY-LAW AMENDMENT

    The purpose and effect of this Township initiated amendment to Comprehensive Zoning By-law 2014-14 is to amend Section 3.2 pertaining to non-complying lots, buildings and structures; to amend Section 4.1 to prohibit plumbing in certain accessory structures and buildings and to increase the maximum permitted height of two story accessory structures and buildings containing a second story sleeping cabin on waterfront residentially zoned properties; to decrease the minimum permitted gross floor area of a dwelling; and to update Section 3.28 h. to address the storage and parking of commercial motor vehicles on residentially zoned properties. No key map is provided because the proposed by-law applies to widespread lands within the Township.

    Township of Muskoka Lakes Planning Division staff will be returning Zoning By-law Amendment Application ZBA-36/21, By-law 2021-116 to Planning Committee for further consideration on Friday March 18, 2022.

    Under consideration is an amendment to the Township’s Comprehensive Zoning By-law 2014-14 to amend existing provisions pertaining to legal non-complying lots, buildings, and structures and to amend and add provisions to assist in regulating the use of accessory buildings in the Waterfront Designation.

    A staff report will be attached to Planning Committee’s Agenda Package, which will be available for download here on Friday March 11, 2022 by end of day. The meeting will be held virtually via Zoom and a link to join the meeting will be included in Planning Committee’s Agenda Package.

    Please be advised that a recommendation to approve By-law 2021-116 is not being considered at the March 18, 2022 Special Planning Committee meeting. A staff report is being presented, which will provide an overview of public feedback received on the draft By-law, as well as options for potential future changes. Should Committee decide on revisions, it is likely that a further Public Meeting on the By-law will be advertised and which will provide additional opportunities for public comments.
